Governing Law

Dispute Resolution Process

In the event of any dispute arising from our professional services or these terms, the parties agree to the following resolution process:

• Negotiation: The parties shall first attempt to resolve the dispute through good faith negotiation for a period of 30 days
• Mediation: If negotiation fails, disputes shall be referred to mediation under the Nairobi Centre for International Arbitration (NCIA) mediation rules
• Arbitration: Disputes not resolved through mediation shall be referred to arbitration under the Arbitration Act, 1995, with arbitration proceedings conducted in Nairobi, Kenya

Jurisdiction

Subject to the arbitration provisions above, the courts of Kenya shall have exclusive jurisdiction over any disputes arising from or relating to our services. The parties submit to the jurisdiction of the Kenyan courts for enforcement of arbitration awards and any matters not subject to arbitration.

Professional Complaints

Clients may also lodge complaints regarding professional conduct with the Institute of Certified Public Accountants of Kenya (ICPAK) through their established complaints and disciplinary procedures.
